UNANIMOUSLY RESOLVED that:

a) An administrative penalty equal to R 1 746.00 IS APPROVED in terms of section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 9654, Grassy Park in accordance with plan no CT-108-K12, drawn by AJ Arendse.




REASONS FOR DECISION:

1. A portion of the main dwelling extension has been built in contravention of the Municipal Planning By-Law, 2015.
2. The contravention can be considered as minor in extent as it is only 6.106 m² being contravened, and the gravity can be considered to be low.
3. The property is in Parkwood, the sites are very narrow there, making it very difficult to build without triggering any departures.
4. The owner has shown good faith in the administrative penalty process.
5. The owner has not previously contravened the By Law.
