Resolution details

UNANIMOUSLY RESOLVED that:

a. An administrative penalty of R 1 026.50 in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 for Erf 120124 Cape Town at Athlone IS APPROVED in terms of Section 98 of the Municipal Planning By-law, 2015, in accordance with plan attached as Annexure B.

REASONS FOR DECISION:

1. Portions of the Wendy house and verandah were constructed in contravention of the Municipal Planning By-Law, 2015.
2. The nature and extent of the contraventions are low key and limited.
3. The contraventions are of a low gravity since they do not pose any safety or health risk.
4. The contraventions have a relatively short duration of ±6 months.
5. The owner has not previously contravened the By-law or any other planning law.
6. The owner submitted an application to rectify the contraventions once she became aware of the infringement, thus showing good faith.
