UNANIMOUSLY RESOLVED that:
a. The application for departures as set out in Annexure A for erf 172878 Cape Town at Wynberg, IS APPROVED in terms of Section 98(b) of the Municipal Planning By-Law 2015
b. The application for consent in terms of Item 87(b) of the Development Management Scheme for air and underground rights for the portion of erf 172878 Cape Town at Wynberg that is zoned Transport Zone 2, IS APPROVED in terms of Section 98(b) of the Municipal Planning By-Law 2015, subject to conditions contained in Annexure A”
REASONS FOR DECISION:
1. Given the size of the property and the linear distance of the departure (±8m) along the common boundary, the setback departure is minor
2. The setback departure from the northern common boundary is only for a portion of the building above the 10m height for a fire escape
3. The proposal is consistent with the character of the area and will not have a negative impact on the neighbouring properties
4. The Manager: Transport for Cape Town - Transport Planning, has no objection to the application
5. The Western Cape Government: Transport and Public Works has no objection to this application
6. Adequate on-site parking will be provided
7. The proposal will not have a negative impact on heritage
8. The proposal is consistent with the Southern District Plan, the Densification Policy, the Transit Oriented Development, Strategy Framework and the Parking Policy
9. Although the proposal does not comply with the Main Road Growth Management Strategy in terms of proposed use, the deviation will have no negative impact on the area and the proposal will improve the sustainability of the Wynberg CBD, which is one of the main objectives of the policy. The demand for commercial and light industrial development has decreased since policy was written whereas the demand for affordable well located dwelling units has substantially increased and thus the deviation from policy is not unreasonable
