Resolution details

UNANIMOUSLY RESOLVED that:

a. An administrative penalty in the amount of R 12 478.00 IS APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 60 Misty Cliffs, in accordance with the plans numbered TFT60/Council/01 to 04 drawn by Jules Good, dated 30 March 2013.


REASONS FOR DECISION:

1. Portions of the alterations and additions were erected in contravention of the Municipal Planning By-Law, 2015
2. The alterations and additions were constructed sometime before 2012 and although an attempt was made to regularize the contravention, this process was never completed
3. The extent of the contravention, although peripheral to the dwelling house, is relatively large given the size of the original dwelling house
4. The gravity of the contravention is relatively serious due to the extent of the alterations/additions
5. As far as can be ascertained, the owner of the property has not previously contravened this By-Law or any previous planning law.
