UNANIMOUSLY RESOLVED that:
a. The application in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law 2015, to permit a second dwelling to be setback 0m in lieu of 3m from the Southern common boundary and garage setback 0.6m in lieu of 1.5m from the street boundary (Penny Gum) in accordance with plan 61755rev0 dated 24 June 2016 IS APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law 2015
REASONS FOR DECISION:
1. The proposal will enable greater flexibility and optimal use of the subject property without any adverse impact on existing rights or the existing surrounding build form
2. Many examples across the City can be found where similar setbacks from the railway reserve have been approved
3. A 0.0m setback and having a structure hard up against the boundary adjacent the railway reserve will enhance the security of the subject property
