Resolution details

UNANIMOUSLY RESOLVED that:

a. The consolidation of unregistered erven 177231 and 177232 Cape Town (portions of Remainder Erf 170145 Cape Town), as per plan of consolidation LUM/00/177231A, IS APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015.

b. The subdivision of the consolidation of unregistered Erven 177231 and 177232 Cape Town (portions of Remainder Erf 170145 Cape Town), as per plan of subdivision LUM/00/177231B, IS APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A.


REASONS FOR DECISION:

1. The development rules for the new erven will be controlled in terms of the existing Architectural Design Guidelines for the estate, as well as the existing land use conditions relating to floor area, coverage and building height.
2. The area contains a wide range of erf sizes, and the proposed erf sizes will not be out of keeping with others in the estate.
3. There will be no negative impact on the surrounding built environment.
4. The proposal is consistent with the Southern District Plan, the Densification Policy and the Municipal Spatial Development Framework which promote contextually appropriate densification. The proposal is also aligned with the Peninsula Urban Edge Policy and the Natural Interface Study Veldfire Related Planning Guidelines.
5. The level of densification is very low (ie only 1 additional land unit will be created).
6. The proposal will have no heritage impact.
7. The transport impact will be negligible.
8. There is adequate infrastructure to accommodate the additional land units.
9. Regarding the consolidation, it must be noted that the scale and massing of the proposed buildings will be in keeping with the existing buildings.
10. The new buildings will be separated from the existing Stonehurst Estate development by open space.
