Resolution details

UNANIMOUSLY RESOLVED that:

a) That a 10% administrative penalty of R 14 007.00 , in terms of Section 129 of the Municipal Planning By-Law, for Erf 3139, 1 Houghton Road, Camps Bay, IS APPROVED in terms of Section 98 of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION

1. The unauthorized building work contravenes the Development
Management Scheme.
2. Though a land use application was submitted, it was incomplete and
subsequently refused in light of the application being incomplete.
3. Despite affording the applicant opportunity to provide information for the
application to be complete, said information was not furnished.
4. The owner was afforded additional time to furnish the additional information
yet still did not receive a response.
5. The owner was also afforded the opportunity to submit an administrative
penalty application for unauthorized building work, however none was furnished.
6. The unauthorized building work was completed.
7. The city has instituted legal action against the owner.
