a) A 2.5% administrative penalty in the amount of R 3 432.00 IS APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, , 2015 in respect of erf 297, Milnerton, for the unauthorized store room
b) An administrative penalty in the amount of R 17 508.80 IS APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 297, Milnerton, for the unauthorized entertainment room/pool house.
REASONS FOR DECISION
1. The proposal has already been completed and has been utilized for such purposes for a number of years. No proof of extenuating circumstances was submitted to warrant the construction without approved building plans.
2. The structures have a negative impact on the streetscape due to the extent, design and height thereof.
