a) The Municipal Planning Tribunal South-western Panel APPROVES an administrative penalty in the amount of R 370.00 in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 4699 Grassy Park at Lotus River.
REASONS FOR DECISION:
1. The garage has been converted into a business use which is in contravention of the Municipal Planning By-Law, 2015.
2. As far as can be ascertained the owner has not previously contravened the Municipal Planning By-Law or any other planning law.
3. The nature of the business is small and the gravity of the contravention is not serious.
4. The owner has not ceased operating the business despite being served a Notice.
