The Municipal Planning Tribunal South-western Panel APPROVES the application for a departure, as set out in Annexure A, attached to the departmental report dated 2016-10-20, for Erf 58254 Cape Town at Claremont, in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

1. This proposal will have a minimal impact on the surrounding neighbours.
2. This application will not result in a change to the character of the area.
3. Enclosing the terrace will not increase the existing height of the top of the roof of the dwelling house.
4. The proposal fits in with the existing architectural style of the existing building.
5. The privacy of the objector’s property will be improved.
6. The magnitude of the departure is small.
