The Municipal Planning Tribunal South-western Panel APPROVES the application for amendment of restrictive conditions, as set out in Annexure A, attached to the departmental report dated 2016-10-18, for Erf 840 Bergvliet, in terms of Section 98(b) of the Municipal Planning By-Law, 2015;

b) The Municipal Planning Tribunal South-western Panel APPROVES the application for Council’s consent in terms of the title deed, as set out in Annexure A, attached to the departmental report dated 2016-10-18, for Erf 840 Bergvliet, in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

c) The Municipal Planning Tribunal South-western Panel APPROVES the application for rezoning of Erf 840 Bergvliet from Single Residential Zone 1 to General Residential Subzone GR2, in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A, attached to the departmental report dated 2016-10-18;

d) The Municipal Planning Tribunal South-western Panel APPROVES the application for consent for a hospital in terms of Item 40(b) of the Development Management Scheme, for Erf 840 Bergvliet, in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to conditions as set out in Annexure A, attached to the departmental report dated 2016-10-18;

e) The Municipal Planning Tribunal South-western Panel APPROVES the application for departures, as set out in Annexure A, attached to the departmental report dated 2016-10-18, for Erf 840 Bergvliet, in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION:

1. Approval of the application will not impact on the character of the area
which has a mix of land uses along Bergvliet Road.
2. The setback departures are technical in nature and will not result in additional building work.
3. The scale of the proposal is moderate and is appropriate in the context of the surrounding built environment.
4. Adequate on-site parking can be provided to accommodate staff and patients.
5. The nature of the medical consulting rooms is quiet and will not create a disturbance to neighbours.
6. Conditions have been imposed to mitigate potential negative impacts.
7. A residential component will be retained.
8. Adequate municipal services are available.
