UNANIMOUSLY RESOLVED that:
The application for subdivision, removal of restrictive conditions, building line, carriage way and floor area departures and city approval, as set out in Annexure A, for Erf 131 Green Point, 101 High Level Street, Green Point BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015 contained in Annexure A.
REASONS FOR DECISION
The MPT REFUSED the application for the reasons set out in the Planner’s Report and agreed to:
Amend reason 1 as follows:
The application is not desirable in terms of Section 99(3) of the By-Law as incorrect information regarding baselines were provided
Amend reason 2 as follows:
Rights of surrounding properties could be adversely impacted.
Amend reason 3 as follows:
The applicant has failed to demonstrate that the removal and amendment of the title deed conditions will not cause financial loss to the area and will be in the public interest given the provision of inaccurate information
