LAND USE MANAGEMENT APPLICATION FORM


The Land Use Management Application form is the only form that should be used when submitting a planning application. Unless it is completed in full and accompanied by the relevant supporting information and documentation (as specified in Council's application submission requirements), the application will not be accepted. POWER OF ATTORNEY

A Power of Attorney authorises a consultant or agent to act on behalf of the property owner when applying for development or other approval, and forms part of the supporting documentation required for planning applications.

Notwithstanding a signed power of attorney, Planning Law requires that only an owner of land may apply and it therefore remains a requirement that the application form still be signed by the owner as well.

Unless the power of attorney form complies with the legal standard, it may not be accepted -
Power of Attorney.

CONVEYANCER'S CERTIFICATE

Some land use applications need to be accompanied by a conveyancer's certificate (a certificate completed by an attorney after he or she has determined whether a property is subject to any title deed restrictions). Unless the conveyancer's certificate complies with this standard, it may not be accepted. Conveyancer's Certificate.

LUPO SECTION 31 CLEARANCE FORM AND INFORMATION SHEET

After the City has approved the creation of new erven as part of a subdivision, and once the roads, water, sewerage and other infrastructure have been installed, it needs to certify that the owner or developer has complied with the relevant conditions of approval. The developer needs this certificate in order to apply to the Deeds registry to have the new erven transferred to the new buyers.

LAND USE MANAGEMENT TARIFFS AND RULES

The documents listed below set out the department's formal tariffs for land use management
applications and explain how they are calculated and applied. Such tariffs are set annually (applicable from 1 July to 30 June the following year) and applicants are required to pay these fees at the time of submission, before their applications will be processed.
