Who are ‘Waste Management Officers’?
- The Director of the Solid Waste Management Department, or an officer appointed in terms of the Bylaw.
- A Waste Management Officer is responsible for regulating, controlling, managing and enforcing the provisions of this Bylaw as well as all national and provincial legislation relating to waste management.
Who from City Waste is legally entitled to access my private property?
- The owner must, on request, allow a peace officer or any other duly authorised employee of the City access to their property for the purpose of inspecting the property and investigating any contravention of this Bylaw and to ensure compliance therewith.
- Any authorised Waste Management Officer.
- The authorised employee must, on request, identify him or herself by producing written proof of such authority. '
- The authorised employee may be accompanied by another to inspect or conduct an investigation. He or she must be identified as such by the authorised employee.
What powers do Waste Management Officers have?
A Waste Management Officer is required to regulate, control, manage and enforce the Bylaw and all other legislation relating to waste management.
- Waste Management Officers are authorised to insist that any legally required licences be produced.
- The Waste Management Officer is entitled to delegate to any other official of the City any of his or her powers or obligations in terms of this Bylaw
