Resolution details

It is recommended that the lease of a portion of City Land, being portions of Erf 40194 and Remainder of Erf 1287 Goodwood, situated at the corner of Peninsula Drive and as shown hatched and lettered A curve BCD on the Plan No TA 979v0 attached and marked annexure A, in extent approximately 900 m², to District Properties CC or its successor in title, be approved subject inter alia to the following conditions, that:A. A market rental of R3 150 per month exclusive of VAT and inclusive of rates be payable;B. The lease will endure for a period of 10 years with a further option of 10 years, subject to a review after every 5 years;C. A six-month termination clause by either party be imposed;D. The set up costs is only applicable to the initial five-year lease period;E. The monthly rental is to be adjusted on the basis of 8% per annum compounded annually on a pro rata basis commencing 6 months after date of valuation. Accordingly, the above recommended rental is to be adjusted as from 2018-12-01;F. The property be used for parking purposes only;G. Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority;H. Subject to compliance with any other statutory requirements;I. No compensation will be payable for any improvement made to the property;J. The applicant must hard surface the parking area;K. The parking area must remain accessible to the general public;L. A detailed parking layout plan must be submitted to the Department of Transport, Roads and Stormwater;M. Any alterations or deviations to electricity services necessary as a consequence of the proposal, or requested by the applicant, will be carried out at the cost of the applicant;N. Unrestricted 24-hour vehicular access and personnel access to the area must be maintained for the purpose of accessing and maintaining electricity services;O. No building or structure of any kind may be constructed on the property;P. No excavation or filling may be carried out and no stakes, pegs or pins may be driven into the ground within 1 m of any part of the electricity services;Q. No plant or material may be stored within 1 m of any part of the electricity services;R. The conditions set by City Parks and attached as Annexure B, must form part of this recommendation and will be included as an Annexure to the lease agreement as special conditions.
